Nicole Richie Will Fight DUI Charge

TMZ was in court moments ago when Nicole Richie's lawyer Shawn Chapman Holley announced her client will try and beat the rap. A trial date was set for July 11.

Richie was arrested last December after she was driving the wrong way on an L.A. freeway. Cops say she confessed that she had been smoking pot and had taken Vicodin.

The stakes are high for Richie. She has a prior DUI and if she's convicted this time around she faces a minimum 5 days in the pokey. Worst case scenario for Richie -- one year in the slammer.

91. If Paris had to due the time than MoST Defenitly Nicole should be doing the time. Nicole is not even as rich as Paris. When was the last time anyone heard from her dad? If it wasn't for Nicole no one would of known of her dad. Nicole gave her family a bad name though.
Even if she is PG she can still have the baby in jail. Alot of women have done it before just sucks it's going to have to be in the pokey.

Really how is Nicole RICH???? She looks like she's a street walking on PCP.

92. It costs $$ to keep and put these rich brats in jail, celebrity justice should exist say 500,000.00 and up in fines, going up each offense as well as house arrest. Why should any one pay for their time. The $ could be used in many different ways. Their sentences make them daily news and they profit from the publicity.

93. #2 You are so right. HERE WE GO AGAIN! Why should the tax payers have to go through this again? SHE WAS DRIVING THE WRONG WAY ON A FREEWAY! In addition, she has a prior DUI. What more do you need? I guess two dead children, one decapitated and a dead mother is what is needed.

WHAT IS WRONG WITH THE STATE OF CALIFORNIA? How many more people will have to die before the lawmakers decide that one DUI is is too many and make the punishment fit the crime. When one of their loved ones is killed we will see a change.

Also, SHAME ON YOU DEFENSE ATTORNIES WHO KNOWINGLY DEFEND AND TRY TO CIRCUMVENT THE LAW FOR YOUR RICH, REPEAT AND GUILTY CLIENTS.

97. Zep is correct. Innocent until proven guilty. There are different facts per each case. A lot of factors like, was the vicodin prescribed? Was the pot prescribed? (talking about california here where pot can be prescribed for even things like depression).

However, regardless of whether it was prescribed there will be factors for a jury to consider like.... What is her responsibility not to operate a vehicle while even taking prescription drugs that impair her ability to drive? Was there also alcohol in her system? Regardless if it was over the legal limit or not when you mix drugs that should not be taken with alcohol you have a whole different offense that could be added?

Yes she has been convicted of DUI before. Which is probably why her attorneys are taking this one to trial. and they should. It's their job to do what's in the best interest of their client. If they get a deal that they know is better than what she will get if convicted AND they know they don't have a strong defense they will advise her to take it. Like they would anyone else.

Remember, (use Paris as an example)... Even the best and most expensive attorney's can NOT change bad facts. Paris had bad facts. Her case is different than Nicoles. She was not sent to jail because she drove under the influence. She was was sentenced for that offense and it included probation. She was sent to jail NOT because the judge was out of order or anyone had anything against her but because she arrogantly broke the terms of her probation multiple times.

No matter what amount of time Nicole gets if convicted or there is a plea bargain, if it included probation (which is likely) and she violates probation she will do the rest of the time in a cell. So if she is lucky enough to get probation, she needs to make new friends, clean her act up and put down the drugs. Especially if she is pregnant. Drug addicted parents may still love their kids but there is a lot of risk they but those kids in. And the emotional damage of dealing with someone you love, much less are dependent on (if your a child) who is on drugs lasts a lifetime.

Now I doubt she has a prescription for the pot. And regardless she will probably reach a plea bargain because she has other drug offenses. While those can not be brought up to determine guilt or innocence they do play into sentencing. And she would be a fool to take that chance.

5 days.. that is the least jail time she could do by law. A year is the max. No one even knows what she will be sentenced to. It depends on the facts of the case, whether a deal is reached, what type of conditions will be involved and frankly whether or not she had a prescription for one or more of the drugs in her system.

I don't care if she does drugs or not. It's sad but it's her body. I do care if she gets into her vehicle and drives while under the influence of them tho. She could probably still pull off a deal that includes 5 days, rehab, random drug testing, probation and community service. Thats fine and if she does all that's required of her she will do no more jail time but keep in mind Paris did jail time because she refused to do what was required of her. I guess no probation dept was gonna tell her what to do. After all they aren't her nanny.

98. Put the drunk in jail. They (Paris, Lindsay, Nichole, Brittney) think that anything go just because they are "bad Tinseltown girls". Enough is enough. Not until they kill somebody like the guy from "'Prison Break' they will not stop. Stop all of them now while there is time. Make an example that that kind of behavior will not be tolerated from anybody, including celebrities. Nicole should serve her time in jail and so is Lindsay for her last car crash. No more throwing the towel. Now I want to see what the Rev. Shapner is going to say in this case since Nicole is black or related to Lionel Ritchie that is black. Come on Rev. what goes in this case. Speak up Rev.

You're wrong. Unlike Paris, Nicole has prior convictions. Secondly, the Sheriff can only let you out for overcrowding or reassign you if the original sentence is less than 90 days. Paris's original sentence was 45 days.

If the judge gives Nicole more than 90 days, she will serve the full time.

102. Not only does Nicole has a previous DUI she also has a heroin bust under her belt. She's doing time. How much depends on if she had a prescription for the Vicodin. I suspect she'll get some court-ordered rehab too.

Nicole...you are DEFINITLY going to JAIL...and i can't see how Lindsay can get out of jail time either......unless it is community service....like 12000 hours of diggin ditches in Barstow...or better yet...being a bus person or waiter, cleaning up the dirty plates and glasses at her old hangouts...THAT WOULD BE THE ULTIMATE.
