Nicole Richie Will Fight DUI Charge

TMZ was in court moments ago when Nicole Richie's lawyer Shawn Chapman Holley announced her client will try and beat the rap. A trial date was set for July 11.

Richie was arrested last December after she was driving the wrong way on an L.A. freeway. Cops say she confessed that she had been smoking pot and had taken Vicodin.

The stakes are high for Richie. She has a prior DUI and if she's convicted this time around she faces a minimum 5 days in the pokey. Worst case scenario for Richie -- one year in the slammer.

20. she only has 1 DUI the second offense was driving on Vicadin and pot. She wont spend time in jail.

21. My 25 yr. old brother died from a drunk driver. They act like it's a big game.... lets get drunk,smoke pot,take drugs then drive. Just because they don't care about their own life's doesn't give them the right to risk taking someone else's life. Pregnant or not throw her in jail. She was laughing about her DUI on David Letterman. Guess it's not so funny anymore after she talked w/ her BFF Paris. Good for Lindsey for canceling her birthday bash.

23. She doesnt have 2 DUI's, she has one and then she was cited for driving while taking vicodin and pot. She wont spend 90 days in jail a few days maybe.

26. I am going to be very mad if she doesn't get any jail time at all OR if she gets less jail time than what Paris serves. What Nicole did was much worse than what Paris did so therefore since Paris served jail time Nicole should as well.
