45 Days, Her Ass?!

Just because Paris Hilton was sentenced to 45 days in jail, it doesn't mean she'll do the time. Because of overcrowding and other issues, L.A. inmates often get sprung early.

Former "Lost" star Michelle Rodriguez was sentenced to 60 days in the very same facility in which Paris is scheduled to do time for the very same offense -- probation violation over a DUI conviction. Rodriguez served a grand total of 2 hours before jail officials told her to get lost.

Per an LA Times article:
Until late last year, overcrowded jail facilities in the county had led Sheriff Lee Baca to release most inmates early, including immediately processing out anyone sentenced to less than 90 days in jail. That is no longer true, and Baca's spokesman, Steve Whitmore, said Friday that his understanding of the judge's order meant Hilton was likely to serve the full 45 days.

63. absolutely she should go to jail even if she doesn't serve the full 45 days. If it had been anybody else, that is someone who isn't in the public eye and doesn't have her money, they would have already gone to jail and served alot longer sentence then she is going to!!!!

68. Ha I think Paris should have to pull her 45 days with NO early release and also have to wear the electronic bracelet for 90 days. She gets by with too much because she has the money to do so.. Shes a train wreck.. Just shows money can't buy everything..class, morals..etc..

69. A Los Angeles County Superior Court judge has sentenced Paris Hilton to 45 days in LA County jail for violating her probation. Her sentence will start on June 5, and the judge made sure she wouldn't be allowed on work release, furloughs, use of an alteranitve jail, or electronic monitoring instead of jail.

The judge said she must do all the time and it not allowed a work release, use of an alternative jail or electronic monitoring in lieu of jail. She will serve at a woman's jail in Lynwood, CA.

72. Paris' time served will NOT be 10x more debilitating than us 'normal folks'. Many of us have kids, jobs that we have to be at in order to pay our bills, and more. She doesn't have that. What will she be missing? Parties. More chances to drive on her suspended license. Oh poor baby she won't be able to get her hair done. After reading comments, I'm starting to think her fans are dumber than she is, and that's saying something.

73. Sorry to disappoint those of you who seem to derive delight in the prospect of Hilton serving 45 days in jail, but under California law, Ms. Hilton will not serve the full 45 days.

A defendant in this instance is entitled to good time/work time credits (which are given by the sheriff irrespective of whether the inmate actually works). The most an inmate in Hilton's situation can serve is 2/3 of her sentence. Thus assuming no early release due to overcrowding, a full sentence means 30 days.

It is customary for most LA county judges in this context to allow any defendant to pay to go to a jail of his/her choice. This saves the taxpayer the financial burden of paying for the incarceration of the defendant while still depriving the defendant of her liberty and imposing a substantial punishment.

It is likely that Hilton is not being afforded this option because of who she is. Thus she is being unfairly singled out because of her status. The conditions in LA county jail are notoriously awful. Racial violence by inmates and abusive conduct by the deputies is the norm, although conditions are reputed to be better for women than for men.

I assume she will be housed separately for her protection. I would sympathize with anyone in her position, celeb or not.

75. can't believe, 2 hours? well, life would not be that easy for the rest of us! Oh, please, please, keep paris for her full term! she's going to trun it into some kind of money-making opportunity anyway--exclusive news feature, premium items, who knows what.

Naomi Campbell made, i believe it was, $500,000 from a fashion magazine for her stint at the sanitation department. story and piz arriving daily in haut couture got a lot of attention. of course, no cameras in county jail--even if she makes some money, she'll be roughing it a little. bon appetit, paris!
