Paris 45 Days in the Clink?

Paris Hilton is in big trouble, if the Los Angeles City Attorney has his way. TMZ has obtained documents filed with the court, in which prosecutors say they want Hilton to spend 45 days in jail.

Paris must appear tomorrow on a probation violation, for allegedly driving on a suspended license. Hilton was already on probation after pleading no contest last January to alcohol-related reckless driving. The DMV had suspended Hilton's license as a result of her DUI bust.

While her license was suspended, Hilton was stopped by the CHP last January 15, and again by the L.A. County Sheriffs on February 27.

The City Attorney will argue that Hilton certainly knew after she was stopped in January that she wasn't allowed to drive, so the second stop was a flagrant violation of law.

The documents suggest Hilton mistakenly relied on her lawyer's assumption that Hilton had a right to drive, but the City Attorney claims in the legal papers that it's a bogus argument.

According to the papers, Hilton also failed to enroll in an alcohol education program within 21 days of the order directing her to do so.

The legal papers ask that "Hilton be ordered to serve 45 days in County Jail." Prosecutors also want her to be ordered "not to consume any alcohol for a continuous period of 90 days." During that 90-day period, prosecutors want her "to be monitored for alcohol consumption ... by use of a Secure Continuous Remote Alcohol Monitoring (SCRAM) device at her expense."

The City Attorney wants more. Because of her "flagrant" driving violations, they want her license suspended for an additional four months -- and they want her car impounded for 30 days.

Hilton violated the terms of her probation/release THREE times, twice for driving with a suspended license + failing to register/enroll in an alcohol treatment program as a condition of her release by a date certain as ordered by the court. Three violations would normally deserve some jail time (up to 90 days) without a doubt, but I'm afraid that, unfortunately, the most punishment she will receive is community service + be forced to wear a SCRAM (alcohol detetection) monitoring ankle bracelet. Any fine levied by the court would be totally insignificant to her anyway. This was her first DUI violation + in L.A. [they] go easy on these offenders, even when they do not comply with their probation conditions, unless physical injury or death resulted. Too bad she is unlikey going to serve any jail time, but this is typical because of overcrowding conditions in L.A. County detention facilities, NOT because of her wealth or celebrity.

65. How much would I love to see her ass in jail????!!!!! Such a wonderful thing and SO HOT!

It could be the beginning of the end of us seeing her ad nauseum...I can't wait! How humiliating for her and her "prestigious" family!

As they say, "The rich are different from us..." Yeah! Most of us don't do time for drunk driving, disobeying court orders, etc! Some of us actually obey the law and don't have a hard time doing it! ROT IN JAIL, PARIS.

66. I live in Indiana and the only time anybody has ever gone to jail for driving while suspended was aftere they did it about 5 times. She won't go to jail for that. What they need to do is give people jail time for the 1st offence driving while intoxicated. One year for the 1st, 2two years for the 2nd, ect.

68. #68, You sound like a person in the know. I have a question. If she is free due to over crowding couldn't the judge put her under house arrest with the anklet and the SCRAM device. Plus have drug tests run every few days. I am sure good law abiding citizens would contribute to get her a motel room in a bad part of town for her incarceration.

70. she will buy her way out, i was busted for a dui and they took my car for 30 days, had to go to dui school another 400.00 and had my license suspended for a year, 1st time dui in san bernadino county, ca. the parasite will prove what everyone already knows money talks yada yada, kudos to the prosecutor for trying to do whats right! just for the publics sake we all know she's above the law, she'll be driving out of a club again.

71. I will have a renewed faith in the celebrilegal system if this chick goes to jail. Just thinking about the prospects of this overhyped spoiled bimbo going into a "commoner" jail makes me smile.
Do I know Paris personally, her character or moral standings? No.
Am I a jerk for enjoying the prospects of having this pointless, ineffective, no-talent paparazzi-magnet wear government stripes? Maybe.
Does she deserve to get slapped into reality along with the other celebritantes? Yep.

73. The only way to finally discipline these over-indulged brats is to shove their faces in it and finally make them do some time for their crime. People like Hilton keep thinking they can get away with repetedly breaking the law and thumbing their proverbial noses at both the law and the enforcers of the law. It's time to teach these kiddies a lesson or two.
